How do you get to Dat Dog? Practice, Practice, Practice! Cuz on May 21, 2014,* Dat Dog will host LIVE performances of the jingle finalists. A panel of celebrity judges will choose the a winner in each of our two categories: 1) Best Jingle by an elementary, middle or high School student or group of students and 2) Best Jingle by an adult or group of adults. Dat Dog Jingle Contest starts on Friday, January 10, 2014 at 12:00 a.m. Central Time and ends on Saturday March 29, 2014 at 11:59 p.m. All entrees are due by April 14, 2014 at 11:59 CT.
ELIGIBILITY: Contest is open to all citizens of the world. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws. This Contest is in no way sponsored, endorsed or administered by, or associated with YouTube. By entering this Contest, you understand that you are providing your information to Dat Dog and not to YouTube.
HOW TO ENTER: During the Contest Period, you must visit the Dat Dog web site and complete the entry form. Jingles must be no longer than :60 (sixty) seconds in length and must be submitted by providing a link to a video of the jingle being performed on YouTube. Entries will be divided into two categories for judging. Dat Dog must receive all Entries by April 14, 2014 at 11:59 p.m. CT to be considered. Entries generated by script, macro or other automated means or by any means that subvert the entry process are void. Limit one (1) Entry per person per category and per email address and per YouTube account throughout the Contest Period. Entries received from any person or email address or YouTube account in excess of the above-stated limitation will be void. By submitting an Entry, each entrant agrees to comply with the Terms of Service and/or Community Guidelines for the website or application through which his/her video is submitted. A YouTube account may be required to enter this Contest and is available for free at ww.youtube.com. Data rates may apply. See your wireless service provider about pricing plan details.
CATEGORIES: A jingle can be submitted in two categories: 1) A jingle created and performed by an elementary, middle or high school student or group of students, and 2) A jingle created and performed by an adult or group of adults. If submitting in Category 1, the entrant(s) must have an adult teacher or school as the sponsor and the consent of adult family members/guardians. Anyone under the age of 20 who is still in high school will be considered an entrant in Category 1. Anyone older than the age of 17 who has graduated from high school will be considered an entrant in Category 2.
PRIZES: Each category will carry a cash prize of $500.00 plus a $100.00 Dat Dog Gift Certificate. The Category 1 winner’s cash prize will be made as a gift to the sponsoring school. The winning elementary, middle or high school entry will receive dinner at Dat Dog for up to 50 people. The school party may also carry a fundraising element to which other members of the school community are invited to participate.
REQUIREMENTS OF ENTRIES: Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:
- is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
- promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
- is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
- defames, misrepresents or contains disparaging remarks about other people or companies;
- contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others (except for any Dat Dog elements which may only be used for this Contest in accordance with these Official Rules);
- contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
- contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media) (except for any Dat Dog elements, which may only be used for this Contest in accordance with these Official Rules);
- contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
- contains look-alikes of celebrities or other public or private figures, living or dead;
- communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or
- violates any law.
Entry must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the Entry contains any individuals other than the entrant, the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry, necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein.
By submitting an Entry, entrant acknowledges and agrees that Sponsor may obtain many Entries in connection with this Contest and/or other contests staged and/or promoted by the Sponsor, and that such Entries may be similar or identical in theme, idea, format or other respects to other Entries submitted in connection with this Contest and/or other contests sponsored by the Sponsor or submitted for other reasons or other materials developed by the Sponsor. Entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the entrant may be similar to his/her Entry, or that any compensation is due to entrant in connection with such Entry or other works used by Sponsor.
By submitting an Entry, entrant hereby grants permission for the Entry to be posted at datdog.com or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry and may remove a posted Entry at any time or for any reason whatsoever.
JUDGING: A panel of judges will review all entries and determine who shall become eligible to advance to the final stage of the competition. The panel of judges will also be solely responsible for selecting the winners. Those selected will be asked to perform their jingle/video at a Dat Dog location before a live audience. Again, the judges will select finalists from each category to perform one at a time at the grand finale. There the judges will select and anoint the winner. The panel of judges to select the winner will use the following criteria: Creativity (25%), Adherence to the Dat Dog brand (25%) Originality (25%) and Popularity (25%). In the event of a tie, the Entry among the tied Entries with the highest score in the criteria of creativity will be deemed the potential winner. Sponsor reserves the right not to award a prize for an applicable Category if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries for the applicable Category. Prize awards are subject to verification of eligibility and compliance with these Official Rules.
WINNERS NOTIFICATION: Judges and Sponsor’s decisions are final and binding on all matters relating to this Contest. Potential winners will be notified by email and will be required to perform their jingle entry at Dat Dog on May 10, 2014 (Dat Dog reserves the right to change the date of this final round, if needed) and complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor, which must be returned to and received by Sponsor within fourteen (14) calendar days of the date appearing on prize notification. Return of a prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by a potential winner will result in disqualification. If potential winner is at least 18 years of age but still considered a minor in his/her jurisdiction or residence, prize may be awarded in the name of his/her school, who will be responsible for fulfilling all requirements imposed on winners as set forth within.
PRIZES: The elementary, middle or high school winner ‘s school will receive $500.00 plus a $100.00 gift certificate and a Dat Dog party up to 50. The winner of the adult jingle category will receive $500.00 plus $100.00 gift certificate. Dat Dog maintains the exclusive right to utilize the winning jingles and jingle videos for any purpose associated with their lawful business and applicant hereby consents to said right. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by the Sponsor.
Winners may not substitute, assign or transfer a prize, or redeem for cash. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor and YouTube and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or selection as a winner.
Contest-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. By participating, each entrant also agrees not to release any publicity or other materials on his/her own or through someone else regarding his/her participation in the Contest without the prior consent of the Sponsor, which it may withhold in its sole discretion.
USE OF VIDEOS: By submitting an Entry, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your Entry and all elements of such Entry, including, without limitation, the video and the likenesses of any locations and persons embodied therein, in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries, videos or hyperlinks; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, videos or hyperlinks, the announcement of the prizes, the incorrect uploading of a video or any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void.
Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non- authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, determine the potential winner(s) for the applicable Category(ies) from all eligible, non-suspect Entries received for the applicable Category(ies) prior to action taken using the judging procedure outlined above. In the event of a dispute regarding online entry, Entry will be deemed made by the authorized account holder of the e-mail account associated with the Entry and he/she must comply with these Official Rules. The authorized account holder is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Contest, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with laws of the State of Louisiana, USA.
